SellerAction LLC — Terms of Use
Effective Date: April 1, 2026
These Terms of Use (“Terms”) govern your access to and use of selleraction.org (the “Site”) and any services, tools, or content provided by SellerAction LLC (“SellerAction,” “we,” “us,” or “our”). By accessing or using the Site, submitting any information, or interacting with our services, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Nature of Service
SellerAction is an independent, for-profit advocacy and information platform. We collect, analyze, and present user-submitted information to identify patterns affecting Amazon third-party sellers and may share insights with media, regulators, and third parties.
SellerAction is not a law firm, does not provide legal advice, and does not represent users in any legal capacity. No attorney-client relationship is created.
2. Eligibility
The Site is intended for use by individuals who are at least 18 years of age and have the legal capacity to enter into these Terms. By using the Site, you represent that you meet these requirements.
3. User Responsibility & Assumption of Risk
By using the Site or submitting information, you acknowledge and agree:
You are solely responsible for any information you provide. You understand that submitting information related to Amazon or other third parties may carry risks, including but not limited to account action, business impact, or legal consequences. You voluntarily assume all risks associated with your use of the Site and any submission of information.
SellerAction shall not be responsible for any consequences arising from your participation.
4. User Submissions
4.1 Representations
By submitting any content (“Submission”), you represent and warrant that: the information is true, accurate, and not misleading to the best of your knowledge; you have the legal right to share the information; and your Submission does not contain knowingly false, defamatory, or unlawful statements.
4.2 License
You grant SellerAction a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, analyze, publish, distribute, and create derivative works from your Submission for advocacy, research, regulatory, journalistic, and commercial purposes.
4.3 Editorial Control
SellerAction reserves absolute discretion to review, edit, summarize, anonymize, or decline to use any Submission. We do not independently verify all user submissions and disclaim responsibility for their accuracy.
5. Platform Status & Section 230
SellerAction operates as an interactive computer service provider. Content submitted by users is provided by third parties, not SellerAction.
To the fullest extent permitted under 47 U.S.C. § 230, SellerAction shall not be treated as the publisher or speaker of user-generated content.
6. No Duty to Act
Submission of information does not obligate SellerAction to take any action, including investigation, publication, legal referral, or advocacy. We make no guarantees of outcomes.
7. Amazon Damage Calculator
The Amazon Damage Calculator is provided for informational and illustrative purposes only. Calculations are estimates based solely on user-provided inputs. Results do not constitute a legal determination of damages, a professional financial assessment, or legal advice. Actual damages may differ significantly. SellerAction is not liable for any decisions made based on calculator results.
8. Legal Referrals
SellerAction may refer users to third-party attorneys. Any such referral: is provided for convenience only; does not constitute legal advice or endorsement; and may involve compensation to SellerAction for marketing or referral services, where permitted by law.
Users are under no obligation to engage any referred party.
9. Data Use & Privacy
9.1 Data We Collect
We collect information you voluntarily provide, including your name, email address, Amazon seller account details, story narratives, financial estimates, and other information submitted through our forms. We also collect standard technical data such as IP addresses, browser type, and usage data.
9.2 How We Use Your Data
We use your data to operate and improve the Site; analyze patterns of seller harm for advocacy purposes; communicate with you about your submission and SellerAction news (with your consent); refer your information to legal organizations (with your consent); and comply with legal obligations.
9.3 Data Sharing
We do not sell your personal data. We may share your data with journalists and regulatory agencies for advocacy purposes (anonymized unless you consent otherwise); plaintiff’s attorneys for legal referral purposes (with your consent); service providers who assist in operating the Site; and law enforcement or government agencies when required by law.
9.4 GDPR Rights (EEA and UK Users)
If you are located in the European Economic Area (EEA) or the United Kingdom, you have the following rights under GDPR and applicable UK law:
Right of Access — You may request a copy of the personal data we hold about you.
Right to Rectification — You may request correction of inaccurate or incomplete data.
Right to Erasure — You may request deletion of your personal data, subject to legal retention obligations.
Right to Restriction — You may request that we restrict processing of your data in certain circumstances.
Right to Data Portability — You may request a copy of your data in a structured, machine-readable format.
Right to Object — You may object to processing of your data for direct marketing or legitimate interests.
Right to Withdraw Consent — Where processing is based on consent, you may withdraw consent at any time without affecting the lawfulness of prior processing.

9.5 Legal Basis for Processing (GDPR)
For EEA and UK users, our legal bases for processing your personal data are: your consent, where obtained through our forms; our legitimate interests in operating an advocacy platform; and compliance with legal obligations.
9.6 Data Retention
We retain your personal data for as long as necessary to fulfill the purposes described in these Terms, or as required by law. You may request deletion at any time by contacting hello@selleraction.org.
9.7 International Transfers
SellerAction LLC is based in the United States. If you are located outside the United States, your data will be transferred to and processed in the United States. We implement commercially reasonable safeguards but do not guarantee absolute security.
10. Disclaimer of Warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” SELLERACTION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: SELLERACTION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. TOTAL LIABILITY SHALL NOT EXCEED $100. THIS LIMITATION APPLIES REGARDLESS OF LEGAL THEORY.
12. Indemnification
You agree to defend, indemnify, and hold harmless SellerAction and its affiliates from any claims, damages, liabilities, or expenses arising from: your use of the Site; your Submissions; or your violation of these Terms. This includes claims of defamation, misrepresentation, or legal violations.
13. Third-Party Links
We are not responsible for third-party content or services.
14. Modifications
We may modify these Terms at any time. Continued use constitutes acceptance.
15. Governing Law
These Terms are governed by Florida law. All disputes shall be resolved exclusively in courts located in Hillsborough County, Florida.
